In the event that the client exceeds any of the agreed elements of the scope of use, e.g. makes changes to the appearance of the work or product without the author’s consent or independently extends a batch of products, withholds the name of the author or material information about the sales of the works or products, fails to pay the contractually agreed royalty, or otherwise intentionally or negligently infringes the designer’s copyright, the designer shall be entitled to and may also claim an increased payment of up to 200% of the agreed royalty or usage fee, regardless of whether or not the designer has suffered any pecuniary damage as a result of the infringement.
