The designer, depending on the nature of the order or the agreement with the client, prepares one or more design concepts, which mean different approximately equivalent presentations of an individual design idea. These content foundations are the starting points on which the designer then builds their solutions. The designer presents the design concept to the client, who can choose to accept or reject it.
When the client accepts the design concept (e.g. accepts it without comments or accepts it with minor changes), the designer obtains consent to continue the work.Acceptance of the design concept (based on the previously approved project brief) is considered as acceptance of the contract offer. The client is hereby obligated to pay for the design concept and the ordered elements for design and technical implementation. Even if the client does not use the ordered and produced design solutions, they must pay the designer the full fee for all work performed. The client is also obligated to cover all related costs.
In the event that the design concept did not meet the requirements of the project brief, the client has the right to make major corrections or demand additional design solutions. When the client does not agree with a design concept (or any of the design concepts) for other, personal or professionally unsubstantiated reasons, they can order the preparation of additional design concepts, which are recommended to be re-evaluated. In this case, it is good practice to re-examine the project brief with the client, supplement it when necessary and additionally confirm the supplement in writing.
It is recommended that both accepted and rejected design concepts remain the property of the designer (i.e. the author), rejected designs can be used by the author without restrictions, and accepted design concepts are subject to reserved and non-transferable economic rights. At the request or demand of the author, the client must return the rejected design concepts, that have already been physically carried out through a medium, to the author. Any copying, dissemination, transformation or other use of the design concepts without the written consent of the copyright holder is prohibited.
Drafts, working drawings and files in various software environments created in the process of developing the design concept and the design solution remain the property, possession and ownership of the designer as the author, unless the designer and the client have expressly agreed otherwise. It is recommended that the designer hand over to the client only the material that is necessary for the technical implementation of the order.
