The right of use of a copyright work and the associated royalties must be specified in the contract (which must be concluded in writing). It is advisible that all three different factors in relation to the right of use are determined: the territorial, the temporal and the content-based factor. The latter determines in particular whether the transfer is excluded or non-excluded and specifically regulates the permissibility of transferring acquired rights from the client to the third party. The author retains all rights that are not exclusively or explicitly stated in the contract.
