Scope for use of the service

Royalities for the use of a copyright work are calculated according to the following recommended formula in accordance the permitted types or use of the service:

Vp= (A × B × C ) × V or

Vp= value of the item, which includes the purchase of rights for the agreed types and the use of the service

Vor = recommended value of the design concept[1]

The criteria for assessing the substantive definition of use are different. Primarily, the criteria cover different types of use (and subtypes, for example depending on the media used: printed matter, video/film, electronic media, objects, clothing,…), which are linked to legally defined material rights: the right to reproduce (i.e. technical implementation of the design concept and the production of a certain number of copies), all rights of communication to the public (right of public performance, right of public transmission, right of public broadcasting with phonograms and videograms, right of public display, right of broadcasting, right of broadcasting retransmission, right of secondary broadcasting, right of placing on the will of the public), the right of reproduction, the right of audiovisual adaptation and the right of distribution.

Secondly, the criteria for assessing the scope of use can also take into account the intensity or the scope of the agreed use, such as the number of copies resulting from the design concept, the number of communication channels, the number of viewers reached, the frequency of playback or public communication, circulation, etc.

However, the criteria for assessing the use of the service may also take into account the annual revenue of the client, the number of employees, the price of the publication, the price of the product, the purpose of use and other elements that affect the use of the service.
